1. Acceptance of Terms
By accessing or using the Jobjini platform ("Platform"), you ("Subscriber") agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organization, you represent that you have the legal authority to bind that organization to these terms.
2. The Service
Jobjini provides a cloud-based CRM, estimating, and project management platform. We reserve the right to modify, update, or discontinue features of the Service at any time.
3. Account Responsibilities & Eligibility
Age Requirement: The Platform is intended for use by business professionals. Users must be at least 18 years of age to register an account.
Minor Usage (16-17): We acknowledge that individuals aged 16 or 17 may use the Platform as employees or contractors in the construction industry. However, their use must be conducted strictly under the supervision of a registered Account Administrator who is 18 years of age or older. The Account Administrator assumes full responsibility for any activity conducted by minors under their supervision.
Security: You are solely responsible for all activity occurring under your account. You must notify us immediately of any unauthorized use.
4. Fees and Payment
Subscriptions: Services are billed in advance on a recurring basis via Stripe.
Taxes: Fees are exclusive of applicable Canadian taxes (GST/HST), which will be applied based on your jurisdiction.
Non-Refundable: Except as required by law, all subscription fees are non-refundable.
5. AI and Accuracy Disclaimer
Jobjini utilizes Google Generative AI to assist with data extraction and measurements.
Verification Required: AI-generated measurements and estimates are provided for guidance only. Final verification of all quantities and pricing is the sole responsibility of the Subscriber.
Liability: Jobjini is not liable for financial losses or material errors resulting from reliance on AI-generated data.
6. Ownership and License
Your Data: You retain full ownership of all data and photos uploaded. You grant Jobjini a limited license to host and process this data to provide the Service.
Jobjini Property: The Platform’s design, software, and "Jobjini" branding are the exclusive property of Jobjini.
7. Governing Law
These Terms shall be governed by the laws of the Province of Alberta and the federal laws of Canada. Any legal action shall be brought exclusively in the courts located in Calgary, Alberta.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Jobjini, its directors, or its suppliers be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses. Under no circumstances will Jobjini be responsible for any damage or loss resulting from hacking, tampering, or other unauthorized access or use of the Service. Jobjini’s total liability for any claims under these terms is limited to the amount paid by you to Jobjini in the 12 months preceding the event giving rise to the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless Jobjini and its subsidiaries from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Platform; (ii) your violation of any term of these Terms or the Acceptable Use Policy; (iii) your violation of any third-party right, including without limitation any privacy or intellectual property right; or (iv) any claim that your data caused damage to a third party.
10. Disclaimer of Warranties ("As-Is")
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Use of the Service is at your own risk. To the maximum extent permitted by law, Jobjini disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Jobjini does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any AI-generated outputs will be accurate or reliable.
11. Data Residency and International Transfers
Jobjini utilizes AWS infrastructure located in the United States (Region: US-WEST-2). By using the Platform, you acknowledge and consent to the storage and processing of your data outside of Canada. You understand that data stored in the United States may be subject to the laws of that jurisdiction, including the right of U.S. government authorities to access data under the CLOUD Act or similar legislation.
Jobjini Acceptable Use Policy (AUP)

To maintain the integrity of the Jobjini Platform and protect our infrastructure, all users must adhere to the following rules.
1. AI and Intelligence Tools
Our AI features (powered by Google Generative AI) are designed to help you manage roofing and construction projects. You agree NOT to:
Use Jobjini’s AI to generate content unrelated to construction or project management.
Attempt to "prompt injection" or "jailbreak" the AI to bypass safety filters or extract underlying code.
Use automated scripts to "scrape" data or overwhelm our AI API limits.
2. Business Integrations
When connecting to QuickBooks, CompanyCam, or Google Drive, you agree to:
Only connect accounts that you have the legal right to access.
Avoid using Jobjini as a pass-through to move malicious software or "spam" into these third-party systems.
3. Communication Standards
When using our communication tools (Twilio, Sendgrid, OneSignal for SMS, Email, and Push), you must:
Comply with Canada’s Anti-Spam Legislation (CASL).
Only send SMS or emails to customers who have provided express consent to be contacted.
Not use the Platform to transmit "spam," harassment, or unsolicited commercial messages.
4. System Integrity
You may not:
Use Jobjini to store or transmit any material that contains software viruses or malicious code.
Attempt to gain unauthorized access to our infrastructure (hosted on Supabase, Vercel, and AWS).
Use the Platform for any illegal purpose or in violation of any local, provincial, or federal law.
5. "Human-in-the-Loop" Requirement
Subscriber acknowledges that AI tools may occasionally produce inaccurate or "hallucinated" results. Subscriber agrees to maintain a "human-in-the-loop" workflow, meaning a qualified professional must manually review and approve all AI-generated outputs (measurements, estimates, or data extractions) before they are used for any commercial, safety-critical, or binding purpose.
6. Device Limits
Each user account may be logged in to a maximum of (4) devices at a time. If they attempt to log into more devices, they will be logged out of earlier sessions.
7. Enforcement
Violation of this AUP may result in the immediate suspension or termination of your account without notice or refund.
